My brother plead out this week. If you remember, he was originally sentenced to 40 years for Aggravated Murder by a Jury for killing a man in bar fight with a one handed punch.
Well, his trial was reversed on appeal and he has been back here in the county for the last 90 days waiting for a New trial. After, lots of wrangling and even having the prosecutors ambush me and claim i said my brother was a Black Belt in the Martial Arts-the State offered 12 years on a manslaughter charge-which my brother accepted
he's been locked up for four years now-so he will have to do a minimum of two more to be considered for parole (as opposed to the 20 he was facing on the original sentence) so overall this is a good result and my mother was saved from sitting through a second trial which i truly thought would kill her.
The reality is-he will probably be doing more than two years because he is a hard head who is always getting written up inside the joint and so never ever accumulates any good time but even if he served all his time-he would still be less than 50 when he got out and would still have a chance at some kind of life. _________________ Daniel Webster: You seem to have an excellent acquaintance with the law, sir.

Dave, you were ambushed by the prosecutors trying to claim something you didn't, that's very disturbing.
It does sounds like the appeal process was worth it for your brother for getting the sentence reduced. _________________ Chuck: I don't know anything about you since you were nine.

I was an emotional wreck for the rest of the day.
And yes the appeal process was worth it; so in a real way the system worked. _________________ Daniel Webster: You seem to have an excellent acquaintance with the law, sir.

I'm glad to hear that, Dave.
(Glad to hear the system worked, not about the emotional stress!) _________________ Chuck: I don't know anything about you since you were nine.
